Consumer information on the possibility of opposing telephone canvassing

Since the law of January 6, 1978 relating to data processing, files and freedoms, everyone can oppose the use or transfer of personal data concerning them. In particular, this allows the consumer to object to various forms of commercial prospecting by professionals using their data.

These provisions were reinforced by the HAMON law which inserted in article L. 223-2 of the Consumer Code, the obligation for any professional required to collect a consumer's telephone data to inform the latter of his right to register on the list of opposition to cold calling. This requirement entered into force on June 1, 2016.

If the information relating to the consumer's telephone data is collected at the time of the conclusion of a contract, the contract must mention in a clear and comprehensible manner the existence of this right for the consumer.
